Barilla G. e R. Fratelli S.p.A., with registered office in Via Mantova n. 166, 43122, Parma - Italia or one of the Barilla Group companies for which you are applying, as listed in Annex A of this Privacy Policy (“Barilla”), is committed to protect the privacy of the Candidates who send to Barilla their job application. As such, this document (“Privacy Policy”) has been written in order to allow you to understand how your Personal Data, as hereinafter defined, will be processed by Barilla.

In general, any information or Personal Data which you provide to Barilla, within the scope of research and selection of personnel will be processed in a lawful, fair and transparent manner taking into consideration internationally recognised principles such as purpose limitation, storage limitation, data minimisation, data quality and confidentiality, as indicated within the applicable data protection law (“Data Protection Law”), including (as applicable), but not limited to the following: (i) Regulation (EU) 2016/679 (“GDPR”); and (ii) the California Consumer Privacy Act (as amended, “CCPA”).

1.     Data controller and Data Protection Officer (“DPO”)

Barilla, as identified at the top of this Privacy Policy, is the data controller regarding all personal data processing carried out in the context of the selection process of the Candidates. You can contact Barilla at the following e-mail address: privacy-candidates@barilla.com.

2.     Personal Data processed and source of the Data

Barilla will collect and process Personal Data regarding you (as an individual) that may be such as your name, surname, job title, certifications, an identification number, an online ID or one or more characteristic elements of your physical, physiological, economic, cultural status, which allows you to be identified either by itself, or together with other information which has been collected (“Personal Data”).

Personal Data processed by Barilla may be shared by you (e.g. while applying and/or during any interview) or provided by third parties such as LinkedIn or platform used for applying; this data is the following:

       a.     Job applications

Through your application or during an interview, you may provide to Barilla your professional/employment details (e.g. education, knowledge of foreign languages, professional qualifications, expectations of the candidate and desired workplace, links to your professional profiles on social networks) as well as a photo of you and your cover letter. (“Application”).

Barilla may also ask you to have a webcam interview, in which case your image and voice will also be processed.

Any untrue statements made through the Application and/or at the stage of a possible job offer, could lead to the withdrawal of the job proposal.

        b.    Special categories of Personal Data

Within the Application you may have disclosed (inadvertently or, otherwise, not requested by Barilla) sensitive categories of Personal Data, such as data revealing your racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, or other types of sensitive information relating to you, such as your genetic data, biometric data or data concerning your health.

If your Application contains Personal Data that belongs to special categories of data that are considered particularly sensitive under Data Protection Law, Barilla will only process such data in accordance with the relevant requirements necessary for the processing of such data.   

         c.    Data provided voluntarily by the data subject

As mentioned in the previous section, through the Application you may disclose to Barilla various type of information, that may include Personal Data related to other persons (e.g. references contacts).

In any situation where you decide to share personal data related to other persons, you will be considered as an independent data controller regarding that personal data and must assume all inherent legal obligations and responsibilities. This means, among other things, that you must fully indemnify Barilla against any complaints, claims or demands for compensation for damages which may arise from the processing of this personal data, brought by the third parties whose information have been processed in violation of the applicable Data Protection Laws.

You must make sure that you have these third parties’ consent before providing any information regarding them to Barilla; if not, then you must make sure there is some other appropriate grounds on which you can rely to lawfully give Barilla this information.

3.     Purposes of processing

Barilla intends to use your Personal Data for the following purposes:

  • To examine Candidate’s Applications and to get in contact with Candidates for a possible interview and, in general, for the management of your application ("Recruitment");
  • To send the Candidate updates on new open positions (“Update on new positions”);
  • For compliance with laws which impose upon Barilla the collection and/or further processing of certain type of Personal Data (“Compliance”);
  • To prevent and detect any fraudulent activities carried out against Barilla and therefore to allow Barilla to defend itself in court. (“Misuse/Fraud/Litigation”);


4.     Legal bases for the processing and mandatory / discretionary nature of processing

Barilla’s legal bases to process your Personal Data, according to the purposes identified in Section 3, are as follows:

  • Recruitment: processing for this purpose is needed for Barilla to be able to consider offering you a position and, therefore, is necessary to take steps at your request before (potentially) entering into a contract. It is not mandatory for you to communicate to Barilla your Personal Data for these purposes; however, if you do not, Barilla will not be able to consider your Applications.
  • Update on new positions: processing for this purpose is optional for Barilla and shall be based on the consent freely given by the Candidate;
  • Compliance: processing for this purpose is necessary for Barilla to comply with its legal obligations. When you provide any Personal Data to Barilla, it shall process it in compliance with the laws applicable to it, which may include retaining and reporting your Personal Data to official authorities for compliance with tax, customs or other legal obligations.
  • Misuse/Fraud/Litigation: Information collected for this purpose is used exclusively to prevent and detect fraudulent activities or misuse (for potentially criminal purposes), and, in general, to allow Barilla to defend itself in court, as well as out-of-court and in all the stages preceding litigation, to be considered as Barilla’s legitimate interests.


5.     Recipients of Personal Data

Your Personal Data may be shared with the following list of persons / entities (“Recipients”):

  • Persons, companies or professional firms providing Barilla with advice and consultancy regarding accounting, administrative, legal, tax, financial and debt collection matters and which act typically as data processors on behalf of Barilla;
  • Entities engaged for IT activities (e.g., hosting providers or e-mail platform providers);
  • Persons authorised to perform technical maintenance (including maintenance of network equipment and electronic communications networks);
  • Persons authorised by Barilla to process Personal Data needed to carry out activities for Barilla, who have undertaken an obligation of confidentiality or are subject to an appropriate legal obligation of confidentiality (e.g., employees of Barilla);
  • Other companies within the Barilla’s Group for internal administrative and accounting purposes (including Barilla G. e R. Fratelli S.p.A., which might be involved in the process/decision on your Application) based on the legitimate interest of Barilla (e.g. the sending of your CV to internal managers with whom you may possibly have an interview); Barilla G. e R. Fratelli S.p.A., duly appointed as data processor on behalf of Barilla, for the activities connected with the management of your Application;
  • Public entities, bodies or authorities for purposes of Compliance, Abuse or Fraud, or for binding orders of the Authorities.


6.     Transfers of Personal Data

Given the international presence of Barilla, some of your Personal Data might be transferred to Recipients located in several different countries. Where required by applicable Data Protection Law, Barilla implements appropriate safeguards to ensure the lawfulness and security of these Personal Data transfers, such as by relying on adequacy decisions from the European Commission, standard contractual clauses adopted by the European Commission, or other safeguards or conditions considered adequate according to Data Protection Law.

7.     Retention of Personal Data

Personal Data processed for Recruitment purpose will be stored by Barilla for as long as is strictly necessary for the abovementioned purposes and, in any case, for up to 24 (twenty-four) months since the receipt of the Application or its last update. Barilla will contact Candidates 7 (seven) days before the expiration of this period, in order to request an extension of the retention period or its update. In case of no reply, Barilla will delete the Personal Data collected.

Personal Data processed for Update on new positions will be kept by Barilla for up to 24 (twenty-four) months since the collection of the consent or until revocation of consent, whichever is earlier.

Personal Data processed for Compliance will be kept by Barilla for the period required by the specific legal obligation or by the applicable law.

Personal Data processed for preventing Misuse/Fraud/Litigation will be kept by Barilla for as long as deemed strictly necessary to fulfil the purposes for which it was collected and therefore until the time Barilla is required to keep them to protect itself in court to communicate such data to the competent Authorities.

8.     Data subjects’ rights

As data subject, you are entitled to exercise the following rights before Barilla, at any time:

  • access your Personal Data (and/or a copy of that Personal Data), as well as information on the processing of your Personal Data;
  • correct or update your Personal Data, where they may be inaccurate or incomplete;
  • erasure request of your Personal Data being processed by Barilla;
  • request the restriction of the processing of your Personal Data;
  • exercise your right to data portability: the right to obtain a copy of your Personal Data in a structured, commonly used and machine-readable format;
  • object to the processing of your Personal Data by Barilla;

You can autonomously erase your Personal Data accessing your reserved area and clicking on Options: Settings and Delete Profile button on the bottom right of the page.

To the extent permitted under applicable Data Protection Law, as a data subject, you are entitled to file a complaint with the competent supervisory authority for the protection of Personal Data, or to file a complaint to the judicial authority if you believe that the processing of your Personal Data is being carried out in an unlawful manner.
